Reap Legal – Terms and Conditions

1. Acceptance Process & Definition

At Reap Legal, we uphold the highest professional standards in the Service of Process industry. Clients must understand that service timelines do not begin until full acceptance has been completed. Acceptance is defined as the formal process in which:

  • Reap Legal reviews the submitted legal documents to confirm they are complete and serviceable.

  • Reap Legal agrees to take on the responsibility of executing the Service of Process request.

  • Payment for the Service of Process has been received in full.

Only after all three conditions are met is the request officially accepted, and the service timeline begins according to the selected service tier.

2. Standard Service of Process – Terms & Conditions

Our Standard Service of Process includes the following terms:

  • First attempt is made within 24 to 48 hours of acceptance.

  • Up to four diligent attempts will be made to ensure proper service.

  • Exceptions: Service timelines are subject to holidays, acts of God, or unforeseen circumstances beyond our control.

  • Weekend & Late Submissions: Legal documents received after 12:00 PM (CST) on Friday will be processed the next business day and attempted during the regular workweek.

  • Reap Legal performs to the best of our ability to uphold our commitment and execute service professionally and efficiently.

3. Rush Service of Process- Terms & Conditions

At Reap Legal, we are committed to maintaining the highest professional standard in the Service of Process industry. Our Rush Service of Process includes a first attempt within the first 24 hours and any subsequent attempts required will be completed within 72 hours, subject to the following terms:

  • Acceptance of Service – The 24-hour timeframe begins once Reap Legal has formally accepted the service request, not when the request is submitted.

  • Exceptions – This timeframe is subject to holidays, acts of God, and any unforeseen circumstances beyond our control that may impact service. While we strive to meet our commitments, certain conditions may delay attempts.

  • Weekend & Late Submissions – Any legal documents received after 12:00 PM (CST) on Friday will be processed on the next business day and attempted during the regular workweek. This is the standard, however, for a Rush-Service of Process that has been received after 12:00pm (CST) on Friday and has been officially accepted by Reap Legal, attempts will begin immediately, including Saturday attempts.

Reap Legal will always perform to the best of our ability to uphold our commitment and execute service with precision, professionalism, and unwavering reliability.

4. Actions Taken After Determining a Bad Address

If an address is determined to be invalid, the following steps will be taken:

  • Client Notification: The client will be contacted and informed of the bad address.

  • Skip Trace Investigation: A skip trace will be conducted to determine a more accurate location for the servee.

  • Service Within Coverage Area: If the new address is within Reap Legal’s coverage area, an additional Service of Process Fee will be required to proceed.

  • Service Outside Coverage Area: If the servee is outside Reap Legal’s coverage area, the new address will be provided to the client, but another Process Server within that area will be required to complete service.

  • Reap Legal does not contract out services or recommend other Process Servers. The responsibility to retain another Process Server remains solely with the client.

5. Alternate Service – TRCP 106 Substituted Service

If Alternate Service is required, the following steps will be taken:

  • Completion of Four Service Attempts in accordance with judicial requirements for Substituted Service under TRCP 106.

  • Filing for Alternate Service: Either Reap Legal or the client will complete the TRCP 106 form for Substituted Service Order to be submitted to the court.

  • Client Responsibility: The client is responsible for filing the affidavit with the court and obtaining the judge’s approval.

  • Execution of Substituted Service: Once the TRCP 106 Substituted Service Order is signed by the judge, Reap Legal will complete the service at no additional charge.

6. Actions After Completion of Service of Process – Affidavit Handling

After successful service, the client has the following options for Affidavit of Service preparation:

  • Reap Legal prepares the affidavit using our standardized format.

  • Completion of the Return of Service Form if the County/State of Texas provides an official document within the legal paperwork.

  • Client completes their own affidavit using the service details provided by Reap Legal.

7. Client Responsibility for Filing

  • Reap Legal does not file affidavits with the court.

  • The client is responsible for filing all affidavits with the appropriate court following service completion.

8. Payment & Liability Agreement

  • Payment must be received in full before service begins.

  • Service fees are non-refundable once an attempt has been made.

  • Reap Legal is not responsible for court acceptance or rejections based on improper filing, improper documentation, or court clerical errors.

  • Service timelines are estimates and subject to reasonable delays due to circumstances beyond Reap Legal’s control.

By using Reap Legal’s services, the client agrees to all terms outlined above and acknowledges full responsibility for ensuring proper document filing and adherence to all applicable court procedures.

9. Commercial Registered Agent Terms and Conditions

Definition of a Commercial Registered Agent

A Commercial Registered Agent in Texas, as defined by Reap Legal, is a business entity specifically designated to receive legal documents and official correspondence on behalf of companies, organizations, or individuals. Unlike a standard registered agent, a Commercial Registered Agent operates as a professional service, maintaining a set business address with regular business hours to ensure legal notices, lawsuits, and government filings are received promptly and reliably.

These agents specialize in handling and forwarding legal documents, providing businesses with a consistent and professional point of contact for important legal matters. By choosing a Commercial Registered Agent, businesses ensure compliance with state requirements while maintaining privacy and efficiency in their legal operations.

Limitations of Provided Registered Agent List

Reap Legal may provide clients with a list of Commercial Registered Agents within our coverage area; however, this list is not all-encompassing. If a client requires service to a Commercial Registered Agent not included in Reap Legal’s list, the entity must meet the definition of a Commercial Registered Agent as outlined above.

If the agent provided by the client does not meet Reap Legal’s definition, the Service of Process will instead be classified under Standard Service of Process or Rushed Service of Process, depending on the client’s selection.

Handling of Non-Qualifying Commercial Registered Agents

  • If a client provides a Commercial Registered Agent that does not meet Reap Legal’s definition, the service will be downgraded to a Standard or Rushed Service of Process without a refund or price adjustment.

  • If the client has already paid and Reap Legal has accepted the job, but it is later determined that the provided agent does not meet the definition, the job will still be completed as per the originally agreed-upon terms.

Client Warnings and Grim List Policy

  • If Reap Legal identifies after acceptance that the provided agent does not meet the Commercial Registered Agent definition, the client will be issued a formal warning via notification of this discovery.

  • If the same client repeats this mistake, they will be placed on Reap Legal’s Grim List, resulting in termination of any future dealings with the client.

  • Clients placed on the Grim List will no longer be permitted to request services from Reap Legal under any circumstances.

Client Responsibility

It is the client’s sole responsibility to ensure that the entity they request service for as a Commercial Registered Agent meets the qualifications defined by Reap Legal. Reap Legal is not responsible for misclassifications due to client oversight.

By utilizing Reap Legal’s services, the client agrees to these terms and acknowledges their responsibility in providing accurate information for service requests.
